Once the brand/copyright is sold, it gives the buyer the right to sue for infringement of the brand or copyright. Therefore, it is an actionable claim. As per Schedule III to the CGST Act, 2017 any actionable claim other than lottery, betting and gambling is neither goods nor services and therefore not liable to GST
